WHAT TO DO

What To Do If You're In A Car Accident In Pennsylvania: 10 Steps

Step 1: STAY CALM

  •  This simple step can keep the accident from getting worse.

Step 2: TAKE PRECAUTIONS WITH YOUR CAR

  •  Turn off ignition.
  •  Turn on four-way flashers.

Step 3: RENDER AID

  • Render first aid if qualified.
  • Stop any bleeding.
  • Call an ambulance.
  • Do not move an injured person in any way that could possibly add to the injury.

Step 4: PROTECT THE SCENE FROM FURTHER DAMAGE

  •  Make sure motorists approaching the automobile accident are warned.

Step 5: CALL THE POLICE

  • Always call the police so that there is a car accident report on file.
  • Think before you speak. Tell the police officer the true facts of the automobile accident.
  • Cooperate fully with the police officer.

Step 6: GATHER INFORMATION - WRITE IT DOWN!

  • If you are able, and it creates no danger to yourself or anyone else, get names, addresses and phone numbers from all witnesses.
  • Make a mental note of comments you hear, such as, 'That blue car shot past me.'

Step 7: SEE YOUR DOCTOR

  • Serious injuries do not always result in immediate pain. If there is the slightest chance you may be injured, see your doctor.

Step 8: NOTIFY YOUR INSURANCE COMPANY

  • Cooperate fully with your insurance company.

Step 9: REPORT THE CAR ACCIDENT

  • PA law requires that you file an accident report within two days after a car accident. Your insurance company or the police department will provide you with the standard form.

Step 10: KNOW YOUR LEGAL RIGHTS

If you have been injured, contact a PA car accident lawyer immediately. Consult an automobile accident attorney who is experienced in handling personal injury cases. You can talk to Munley & Cartwright either over the phone or in person at our office. If you are unable to come to the office because of the injuries, then we will meet with you in the hospital or at your home. You do not pay any lawyers fees unless your case is successfully concluded.

Most automobile accident litigations in Pennsylvania are civil actions against someone who is negligent. In automobile mishaps, negligence is the failure of a vehicle operator to exercise due care which resulted in an accident, injury or death. Although it is a difficult allegation to prove, our Pennsylvania car accident attorneys are experienced in demonstrating negligence by preparing the proper documentation, interviewing witnesses and presenting a case that meets the criteria for negligence established by Pennsylvania law. If the accident was caused by a vehicle defect, you may also be eligible to receive punitive damages from the manufacturer or supplier.
